Payne vs. Hall, supra – St. Louis vs. Rutz – 138 U.S. 226 (1891)

In the third edition of Clark on Surveying and Boundaries, the editor cites Payne vs. Hall and St. Louis vs. Rutz in defining an island as:

“land entirely and customarily surrounded by water and does not include land surrounded only in times of high water.”
