BLM rejected the lease application from the Signal Companies because in their opinion, no hiatus exists. BLM contends that the recovered original monuments control the line between the townships and that only one set of monuments has been recovered.
BLM points out that Signal’s claim of a hiatus is based solely on what the plats of survey show and it ignores the condition on the ground. This issue was decided for the Secretary of the Interior by the Solicitor’s Office. Similar cases are now decided by the Interior Board of Land Appeals.
